Terms of Service

These terms are an agreement between you and Holomark(“we”, “us”). By creating an account or using the Holomark app, you agree to them. If you do not agree, please do not use the app.

1. Who may use Holomark

You must be at least 13 years old. If you are under the age of majority where you live, you may only use Holomark with the involvement of a parent or guardian. If you connect an eBay account or buy a subscription, you must be old enough to enter a binding contract where you live.

2. Your account

You are responsible for your account credentials and for activity that happens under your account. Keep your password secure and tell us promptly if you believe someone else has access. One person, one account; do not share or transfer your account without our permission.

3. Your content

Your collection data, photos, and notes remain yours. You grant us only the limited licence needed to operate the service — to store, back up, and display that content to you, and to transmit images you scan to our card-identification provider so it can return a match.

You are responsible for the content you upload. Do not upload anything unlawful, infringing, or that you do not have the right to share.

4. Subscriptions and payment

Holomark offers a free tier and a paid PRO subscription. Free-tier limits are shown in the app and may change; we will not reduce limits you have already paid for during a billing period.

Subscriptions are billed through the app store you purchased from (Google Play, or the Apple App Store in future) — not by us directly.
Subscriptions renew automatically at the end of each period unless cancelled at least 24 hours beforehand.
Cancel or manage your subscription in your app store account settings. Deleting the app does not cancel a subscription.
Refunds are governed by the policy of the store you purchased from. We cannot issue refunds for purchases made through a store, though we are happy to help you contact them.
We may change pricing. Changes will not affect the period you have already paid for, and we will give notice before a renewal at a new price.

5. Pricing data is an estimate, not advice

This is the most important thing on this page. Holomark shows market prices, price history, sold listings, and portfolio values sourced from third-party data providers and public marketplace activity.

This information is provided for general reference only. It may be incomplete, delayed, or inaccurate, and it is not financial, investment, or appraisal advice. Sold-comp coverage in particular represents only a sample of real marketplace activity, so counts and recency may understate how actively a card actually trades. Collectible values are volatile and the price you can actually realise may differ substantially from any figure shown.

Do not rely on Holomark as the sole basis for a buying, selling, grading, or insurance decision. Any decision you make is your own.

6. Card scanning

Card identification is automated and imperfect. It may return the wrong card, the wrong printing, or fail entirely. Always check a scan result before adding it to your collection or listing it for sale.

7. eBay integration

Connecting an eBay account is optional. If you do, you authorise Holomark to create, update, and end listings and to read order information on your behalf, at your direction.

You remain solely responsible for your eBay listings and sales — for their accuracy, for compliance with eBay’s policies and applicable law, for fees, taxes, shipping, and for fulfilling orders. We are not a party to your transactions. eBay’s own terms govern your use of eBay, and eBay may change its API or policies in ways that affect or interrupt this feature.

8. Acceptable use

You agree not to:

Access the service by any means other than the official app, or attempt to reverse engineer, scrape, or automate it;
Use the app’s data providers through us in bulk, resell our data, or build a competing dataset from it;
Interfere with, overload, or attempt to gain unauthorised access to our systems;
Submit deliberately false reports or manipulate community statistics;
Use the app for anything unlawful.

9. Service availability

We aim to keep Holomark running, but we do not guarantee uninterrupted or error-free service. Features depend on third-party providers and may change, break, or be discontinued. We may modify or discontinue features — and will give reasonable notice before removing something significant that PRO subscribers pay for.

10. Suspension and termination

You may stop using Holomark at any time and delete your account in the app or via our account deletion page. We may suspend or terminate accounts that breach these terms or that create risk or legal exposure for us or other users. If we terminate your account without cause while you have an active subscription, you may seek a pro-rata refund of the unused period from your app store.

11. Intellectual property

The Holomark app, its design, and its software are ours and are protected by intellectual property law. These terms grant you a personal, non-exclusive, non-transferable, revocable licence to use the app — not ownership of it.

Pokémon and all related names and images are trademarks of Nintendo, The Pokémon Company, and Creatures Inc. eBay is a trademark of eBay Inc. Holomark is not affiliated with, endorsed by, or sponsored by any of them. Card names and images are used for identification purposes only.

12. Disclaimers

To the fullest extent permitted by law, Holomarkis provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty as to the accuracy or completeness of pricing data.

13. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, nor for lost profits, lost sales, lost data, or losses arising from decisions made in reliance on pricing information. Our total liability for any claim relating to Holomark is limited to the greater of the amount you paid us in the twelve months before the claim, or USD $50.

Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited.

14. Changes to these terms

We may update these terms as the app changes. We will update the “last updated” date, and for material changes we will notify you in the app or by email before they take effect. Continuing to use Holomark after that means you accept the revised terms.
